Acceptance and Professional Use

These Terms govern the use of Creative Studio, made available by Advolve AI Ltda., located at Rua Sader Macul, 96, Brazil.

By accessing or using Creative Studio, you represent that you have the legal capacity and authority to act on behalf of the organization to which your account is linked. You agree to these Terms, the Privacy Policy, and the agreement applicable to the Customer Organization.

If a contract, order form, or specific agreement entered into between Advolve and the Customer Organization contains a different provision, that document will prevail with respect to the corresponding contractual relationship.

Creative Studio

Creative Studio is a creative operations platform that enables users to organize briefs, produce or adapt creative assets for different formats, edit materials, conduct review and approval processes, and prepare files for delivery.

Available features may vary depending on the plan, organization, enabled integrations, workspace configuration, and release stage of each feature. A description on the institutional website does not expand the contracted scope or constitute a commitment to provide any feature that has not been enabled for the organization.

Account, Access, and Responsibilities

You must:

• provide accurate information and keep it up to date;
• protect credentials, codes, and authentication factors;
• use only the account and workspace to which you have been granted access;
• promptly report any suspected unauthorized access; and
• comply with the roles, approval processes, and policies defined by your organization.

The Customer Organization is responsible for designating administrators, inviting and removing users, and configuring internal permissions. Accounts are personal and must not be shared.

Organization Content

The organization and its users retain any rights they hold in briefs, text, images, trademarks, logos, files, comments, and other materials submitted to the Service.

You grant Advolve a limited, non-exclusive authorization, for the period necessary, to host, reproduce, transform, render, and process those materials solely to operate Creative Studio, carry out user instructions, and provide the contracted Service.

You represent that you hold all licenses, authorizations, legal bases, and consents required to use the submitted content, including trademarks, likenesses of individuals, personal data, music, fonts, and third-party materials. Do not submit information or content that your organization is not authorized to process.

Automation, Generation, and Human Review

Certain features may support text or image generation, layout adaptation, rendering, and other production tasks. Outputs may vary and may require adjustment.

Before approving, publishing, or distributing a creative asset, the organization and its users must review the content, offer details, spelling, visual identity, usage rights, regulatory compliance, and suitability for the relevant channel. Creative Studio facilitates this process but does not replace the user's professional judgment or guarantee the absolute exclusivity of any generated output.

Acceptable Use

You may not use Creative Studio to:

• engage in unlawful, fraudulent, abusive, or discriminatory conduct;
• infringe intellectual property rights, privacy rights, rights of publicity, or other rights;
• transmit malware or attempt to compromise security, availability, or integrity;
• access accounts, workspaces, data, or systems without authorization;
• circumvent technical controls, limits, approvals, or permissions;
• reverse engineer or copy the Service except to the extent permitted by applicable law; or
• overload the platform or interfere with its use by other organizations.

We may investigate suspected violations and take proportionate measures to protect the Service, users, and third parties.

Platform Intellectual Property

Creative Studio and its software, interfaces, components, documentation, trademarks, and proprietary materials are owned by Advolve or its licensors. Access to the Service does not transfer any ownership rights in the technology.

Voluntary product feedback may be used to improve the Service, without any obligation to implement a suggestion and without disclosing the Customer Organization's confidential information.

Availability, Support, and Changes

We use reasonable efforts to maintain the security and availability of the Service. Nevertheless, maintenance, provider failures, outages, and feature changes may occur. Specific service levels, support commitments, credits, or warranties apply only when set forth in the Customer Organization's agreement.

We may improve, replace, or discontinue features, subject to our contractual commitments and any required notice.

Suspension and Termination

Access may be restricted or suspended in the event of a security risk, a breach of these Terms, use that harms third parties, a contractual default as provided in the applicable agreement, or a legal requirement. Where possible and appropriate, we will provide the reason and an opportunity to cure.

Following termination, data and content will be handled in accordance with the Privacy Policy, the Customer Organization's instructions, and the applicable agreement. Files uploaded to Google Drive remain under the control of the destination Google Account.

Warranties and Liability

To the extent permitted by law, the Service is provided subject to availability and in accordance with the contracted specifications. Advolve does not warrant that automated outputs will always be error-free or suitable, without review, for every purpose, campaign, or jurisdiction.

The liabilities, exclusions, indemnification obligations, and financial limitations applicable to the Customer Organization are set forth in the relevant agreement. Nothing in these Terms excludes liability that cannot be limited by law or restricts any non-waivable rights.

General Provisions, Governing Law, and Contact

These Terms are governed by the laws of the Federative Republic of Brazil. The competent jurisdiction and venue will be determined by the applicable agreement and mandatory jurisdictional rules.

We may update these Terms to reflect changes to the product, our operations, or applicable law. The current version and its effective date will remain available on this page. Material changes will be communicated when required.

If any provision is held invalid, the remaining provisions will remain in effect. Any failure or delay in exercising a right does not constitute a waiver of that right.
